General Conditions of Sale
Article 1 – Introduction

These conditions aim to define the terms of sale between Berthie and the user, from ordering to services, including payment and delivery.

Validation of the order and electronic signature (law of March 13, 2000 on electronic signature) constitute acceptance of the general conditions of sale.
Unless proven otherwise, the data recorded by Berthie constitute proof of all transactions made on the site www. Berthie.fr between the company and its customers.
Contractual information will be confirmed in writing at the latest at the time of delivery, to the customer at the email address provided by the customer.
Before confirming your order, it is essential for the customer to check the spelling of their first and last name as well as their exact address with the city and postal code.
Berthie cannot be held responsible for these elements which are essential for the successful delivery of your commande.Toute order constitutes acceptance of the prices and descriptions of the products available for sale.
Berthie reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.Article 4 - Availability of products:

Article 5 – Price:
The prices of our products are indicated in euros, all taxes included.
All orders, regardless of their origin, are payable in euros.
Berthie reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time the orders are recorded.
Article 6 – Payment:
The products remain the property of Berthie until full payment has been received.
The customer has the choice of paying for their online purchases when ordering: by bank card (Carte Bleue, Visa, Eurocard, Mastercard, Amex) or by Paypal.
In the event of products being out of stock or unavailable, the customer will be notified as soon as possible so that they can modify their order, with their agreement and according to their wishes.
Berthie implements all means to ensure the confidentiality and security of data transmitted on the web.
As such, the website uses a secure payment module (PayPal) through an exchange of encrypted data (SSL protocol with 128-bit encryption) and at no time Berthie does not keep its customers' banking information.
Article 7 – Delivery - times, shipping and packaging costs:
Deliveries - deadlines:
Items are delivered to the delivery address provided when ordering. The dispatch of the order will be confirmed to the customer on the day of departure by email, provided the customer has correctly provided their email address. To optimize delivery, it is recommended to provide the most accurate address possible where your order can be received during business hours (home, work, acquaintance).
Berthie guarantees the proper delivery of products.
Delivery times are usual average times and correspond to the shipping processing times announced on the product sheets, to which the delivery time is added.
The products are shipped within 3 to 5 working days, while the delivery time is announced depending on the carrier chosen.
Berthie cannot be held responsible for the consequences of a delay in delivery, for any reason whatsoever. This does not give the buyer the right to cancel the sale.

Shipping and packaging costs:
Shipping and packaging costs will be borne by Berthie.
Article 8 – Withdrawal period:
The withdrawal period granted to the customer on the purchase of goods, in accordance with article L 121 16 of the Consumer Code, is 14 clear days from the date of receipt of the order. During this period, the customer may return, without penalty, the product(s) that do not suit him.
The customer may exchange the product(s) ordered or request a refund.
Returns will only be accepted for complete items in new condition, in their original packaging and with their order form for identification.
Items damaged or soiled by the customer will not be accepted.
Article 9 - Conformity of products:
The customer may exchange products that appear to be defective or do not correspond to their order. In this case, they must request this by email within 7 working days of delivery and return the product.
The product will then be exchanged.
In the case of a product exchange, the shipping costs of the replacement product will not be charged to the customer and the shipping costs incurred by the latter will be reimbursed based on the invoiced rate.
Returns will only be accepted for complete items in new condition, in their original packaging with their order form for identification.
Items damaged or soiled by the customer will not be accepted.
Any claim made outside this period cannot be accepted.
Article 10 - Intellectual property:
Berthie has, for all stages of access to the site, the order process, delivery, or subsequent services, only an obligation of means.
All elements of the site www. Berthie.fr whether visual or audio, are protected by copyright, trademarks or patents. They are the exclusive property of Berthie
Any total or partial reproduction of the site www.Berthie.fr is strictly prohibited.
The photographs and texts illustrating the products are not contractually binding. If errors have been introduced, under no circumstances shall the liability of Berthie cannot be engaged.
Article 11 – Responsibility:
The products offered comply with current French legislation and the standards applicable in France. The responsibility of Berthie cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered.
The responsibility of Berthie cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion, or the presence of computer viruses, or any event qualified as force majeure beyond its control, for the following reasons and without this list being exhaustive: flood, fire, storm, strike, riot, accidents, etc., in accordance with case law.
Likewise, it is not responsible for the content of websites to which hypertext links may refer from its own site.
Any link, even tacitly authorized, must be removed upon simple request from Berthie.
Article 12 – Personal data:
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is necessary for processing and delivering orders, drawing up invoices and warranty contracts.
In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Civil Liberties (CNIL) under registration number: 1214248. The customer has, under Article 34 of the law of January 6, 1978, a right to access, modify, rectify and delete data concerning him.

Article 13 – Applicable law and jurisdiction:
These conditions are subject to French law.
Berthie undertakes to comply with all the provisions of the Consumer Code for Distance Selling.
In the event of a dispute and in the absence of an amicable agreement between the parties, jurisdiction will be given to the courts of the defendant's domicile.
